Observatory for the Protection of Social Rights in the European Context

Católica Research Centre for the Future of Law and the Portuguese section of ANESC launched the Observatory for the Protection of Social Rights in the European Context. This Observatory serves the purpose of thinking over the impact of those normative instruments on the national law system, assessing their compliance with supranational sources of law.

The activity pursued by this Observatory is threefold:

(i) Analysis of the rulings and reports of the European Committee of Social Rights, in what concerns the Revised European Social Charter, as well as the case-law of the European Court of Human Rights, as far as the European Convention on Human Rights is concerned, with direct or indirect impact on the national system;

(ii) Analysis of the Portuguese legislation and case law, with a view to assessing its compliance with the international instruments mentioned above;

(iii) Analysis of the relationship between several international instruments arising from different sources (Council of Europe; European Union; ILO, UN, WTO) and the terms in which they are connected with national law, in order to solve potential conflicts and to assess their justiciability and effectiveness.
